About OPALA
OPALA is the seller and contracting business. OPALA is based in Thailand at [BUSINESS ADDRESS TO BE ADDED]. Our business registration number is [TO BE ADDED IF APPLICABLE] and our tax or VAT number is [TO BE ADDED IF APPLICABLE].
Products may be stored, prepared and dispatched from China by OPALA’s fulfilment partners. That fulfilment location does not change the identity of the seller: your contract is with OPALA in Thailand, not with a Chinese fulfilment provider.
02
Using this website
You may use this website only for lawful purposes. To place an order, you must have legal capacity to enter into a contract and provide accurate, complete and current information.
Product images and colours are presented as accurately as reasonably possible, but screens, natural gemstones, crystals and handmade finishes may vary. Small variations are not necessarily defects.
03
Orders & contract formation
Placing an order is an offer to buy. An automated acknowledgement confirms receipt, not acceptance. A binding contract forms when OPALA sends an order acceptance or dispatch confirmation, whichever occurs first. OPALA may decline or cancel an order before acceptance, including for stock, pricing, payment, fraud-prevention or delivery restrictions, and will refund any amount collected.
Please review personalization, size, metal, stone, address and contact details before ordering. Contact us promptly if something is incorrect; changes may not be possible after production or dispatch begins.
04
Prices, payment & taxes
Prices and available currencies are shown on the website. The payment methods offered to a customer may include PayPal, Visa, Mastercard, other supported cards, iDEAL or PromptPay QR, depending on location, currency and checkout availability.
Unless checkout expressly says otherwise, import duties, taxes, customs charges and carrier fees are not included and may be payable by the recipient. OPALA will show shipping charges and any taxes it collects before order submission. We may correct an obvious pricing error before accepting an order.
05
Products, care & customization
OPALA may offer gemstone, crystal, sterling silver, gold-plated and lab-grown diamond jewelry, including made-to-order, personalized and custom-designed pieces. Product descriptions identify the principal materials and, where relevant, care guidance.
Custom or personalized work begins only after the required specifications and payment are received. Approval of a design, engraving, measurement or other specification makes you responsible for the accuracy of that approved detail, without limiting rights relating to OPALA’s failure to follow the approved specification or other mandatory quality rights.
06
Delivery & risk
Available destinations are shown at checkout and may include selected countries in Western Europe, the United States, Australia, New Zealand and Thailand. Delivery estimates are estimates, not guarantees, unless OPALA expressly agrees otherwise.
Risk of loss passes when you or a person you nominate takes physical possession, except where mandatory law provides otherwise. Please see our Shipping Policy for dispatch, customs and failed-delivery details.
07
Cancellations, returns & defects
Eligible standard products may be returned under our 14-day change-of-mind policy. Qualifying EEA and UK consumers may also have statutory withdrawal rights. Clearly personalized or bespoke goods may be excluded from change-of-mind or statutory withdrawal rights where law permits.
Nothing in these terms limits remedies for products that are defective, incorrect, unsafe or materially non-conforming. See our Cancellation & Refund Policy.
08
Intellectual property
The OPALA name, branding, site design, copy, photographs, graphics and product designs are owned by or licensed to OPALA and protected by applicable intellectual-property laws. Personal, non-commercial browsing is permitted. Reproduction, scraping, republication or commercial use requires prior written permission.
Reviews or other content you voluntarily submit must be lawful and must not violate another person’s rights. You grant OPALA a non-exclusive licence to display and use that content for the purpose for which it was submitted, subject to applicable privacy law.
09
Liability & mandatory rights
Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including liability for fraud, wilful misconduct, death or personal injury caused by negligence where applicable, or mandatory product and consumer guarantees.
To the extent permitted by law, OPALA is not responsible for indirect or unforeseeable losses, business losses arising from a consumer purchase, or loss caused by events beyond reasonable control. Any permitted limitation is applied only to the minimum extent allowed by applicable law.
10
Governing law & disputes
These terms and contracts with OPALA are generally governed by the laws of Thailand. The courts of Thailand may have jurisdiction, but this choice does not deprive you of mandatory consumer protections or rights to bring proceedings available under the law of your country of residence.
Please contact [SUPPORT EMAIL TO BE ADDED] first so we can try to resolve a concern. Nothing in this section requires a consumer to waive access to a regulator, court or dispute process that cannot lawfully be waived.
11
Changes & contact details
We may update these terms prospectively. The version in force when we accept your order normally governs that order unless a change is required by law or agreed with you.
